Daniel Penny trial reveals "bombshell" news that Jordan Neely was still alive when police showed up but officers didn't administer mouth-to-mouth

Everything we find out about the Daniel Penny case continues to confirm that the New York justice system is way out of whack.

Penny is facing charges of manslaughter and criminally negligent homicide for the 2023 death of a homeless man, Jordan Neely, who was threatening to kill passengers on an NYC subway.

We've covered details of his case multiple times in the past.

However, now that the trial has begun a new bombshell has dropped. Neely was still alive when the cops showed up, but the cops did not do everything possible to save Neely.

What was revealed in court is that the cops found Neely, found that he had a pulse, Penny admitted to the hold and knocking him out, and then the police administered CPR and a dose of Narcan to reverse overdose, with no success.

Police, however, chose not to do mouth-to-mouth on Neely because, according to the officer in charge, he was clearly a drug user, he was extremely dirty, and the chance of officers getting something like hepatitis was too high.

To protect his officers, the Sergeant made the decision to wait until paramedics arrived.

'If he did wake up he would have been vomiting. I didn't want my officers to do that.

'He was filthy. He looked like a homeless individual. You have to protect your officer,

'I wouldn't want my officer to get sick if the person throws up,' he (the Sergeant) said.

Neely was not pronounced dead until he arrived at the hospital, more than hour after the initial incident with Penny.

This kind of detail probably would have been important for the people to know and for the press to ferret out before the Soros-DA got his grubby paws on this case to bring it to trial.

And the prosecutor in this case, as you might imagine, is going all in on the emotional manipulation.

'He quite literally, went for the jugular,' Assistant District Attorney Dafna Yoran said.

‘We pass people like Jordan Neely every day. As New Yorkers, we train ourselves not to engage, not to make eye contact, to pretend people like Jordan Neely don't exist.'

...

‘He pushed Mr Neely to the point of no return, certain to die. When he did let go, he left Neely on the floor and didn't look back. He picked up his hat, dusted himself off, and stood over his body.'

Talk about a wild version of events.

Penny restrained Neely while he was fighting to get free after Neely threatened multiple people on the train.

The defense helpfully explains why the prosecution's allegations are not tethered to reality.

While the state intends to argue that Penny never let up the initial pressure he placed on Neely's neck, the defense insists he made several attempts to loosen his grip, and that only had a light hold on Neely by the time he stopped fighting back ...

‘This struggle did last five to six minutes. But Danny was not, and could not, have been squeezing his neck. We know that because if he was, Neely would have passed out in the first minute,' Kenniff said.

I think it's clear that this trial is nothing like the mainstream media and the leftist New York prosecutors want us to believe. Let's check out some of the reactions to the bombshell.

Matt is wrong about the CPR detail, however he is not wrong that the police stopped short of making every lifesaving effort.

I hope that Penny is able to hold true to his name and drain every last penny out of the media and New York City for what they've said about him.
