Remember earlier this year when Florida passed a tremendously great law that would allow child rapists to be executed?

Well, the first test case for the new law is being brought by a North Florida prosecutor who wants to seek the death penalty for a man, Joseph Andrew Giampa, indicted for the rape of a 12-year-old child.

"Given the severity of the crime and its impact on the community, the Fifth Judicial Circuit State Attorney's Office has filed a notice that it intends to seek the death penalty," Gladson's office said in the release.

"The decision to pursue the highest penalty reflects the gravity of the charges and the State Attorney's Office's dedication to holding criminals accountable for their actions," the prosecutor's statement continued.

Giampa allegedly abused an unidentified 12-year-old child and reportedly showed undercover cops a video of the child performing sex acts on the man and being forcibly raped.

Florida Gov. Ron DeSantis has thoughts on the case:

As Governor DeSantis states, this will require appealing to the Supreme Court for this punishment to be carried out - the death penalty is only allowed in limited circumstances and SCOTUS ruled against the death penalty for child rapists in 2008.

We'll see what happens.
