Federal appeals court upholds block on deportation of violent Venezuelan gangsters

Not really sure I can say anything nice about this.

The 2-1 decision by the U.S. Circuit Court of Appeals for the District of Columbia leaves U.S. District Judge James Boasberg's restraining order in place, marking a setback for Mr. Trump.

Judge Karen L. Henderson said the danger of allowing deportations that later turn out to be erroneous was too great at this point to lift Judge Boasberg's blockade, which she said is in place to give all sides more time to figure out whether what the government is doing is legal.

Yes, Judge Karen is very concerned that there's a chance we accidentally deport an innocent illegal alien who only broke our border laws and didn't rape or murder Americans.

Because of that, we have to keep all the rapist murderers here. Better safe than sorry!

She also cast doubt on that question, saying at this point the administration has made only weak arguments for why illegal immigrants from the Tren de Aragua gang constitute an 'invasion' or 'predatory incursion' under the terms of the Alien Enemies Act, a 1798 law Mr. Trump hopes to use to speed the deportations.

Yeah, there's no way that Venezuela, which is undergoing crippling poverty and food shortages (thanks, communism!) and also really hates the United States, would come up with the idea to empty its jails and send all the gangbangers to America.

There's no way that Venezuela would want to save costs on incarceration and hurt America, its sworn enemy. Trump is probably making that all up.

Oh.

Judge Henderson, a George H.W. Bush appointee, said the founders understood invasions and incursions to be acts of war by a foreign nation and 'migration alone did not suffice.'

I tell ya. Imagine if we could go back to the early 1800s and tell the Brits that they could win back America by shipping a bunch of "migrants" over the border to set up gang operations that aren't technically official declarations of war.

I bet Washington, Adams, and Jefferson would have just thrown up their hands and said, "Darn, what can we do??"

Siding with her was Judge Patricia Millett, an Obama appointee who was more emphatic in rejecting the Trump administration's arguments.

She said the way the administration has handled the deportations so far lacks 'even a gossamer thread of due process' for the gang suspects — many of whom, she said, may not actually be members of the gang at all.

This judge has more sympathy for foreign criminals than she does for her own countrymen.

The heat map showing how liberals care more about strangers than their own neighbors, family, and friends continues to be true.
