In a world where California exists, it's always great to see something good happen, especially when it's in California!
A federal judge ruled Thursday that California's ban on assault weapons violates the Second Amendment.
U.S. District Judge Roger Benitez cited the Supreme Court's ruling against a New York gun control law last year in his decision to overturn the California measure, which was first implemented in 1989.
Benitez said in striking down the law that there were "no founding era dead ringers or historical twins" for California's restrictions and "that state legislators had no precedent for banning semi-automatic firearms."
The same judge was recently called an extremist zealot by California Gov. Gavin Newsom (because anyone who isn't a metrosexual commie is an "extremist" to that guy) after Benitez struck down the state's ban on hiGh-cApAciTy magazines (AKA the standard size everyone on the planet uses).
Remember, Gavin gets an armed security detail, but you get to die when the bad guys shoot you.
Benitez actually struck down the ban in 2021 but it was challenged, but the new ruling is a direct result of the Supreme Court's 2022 case New York State Rifle & Pistol Association v. Bruen. That landmark decision re-framed the legal debate on gun rights starkly in favor of the rights themselves: Judges under Bruen are now required to consider the "historical tradition of firearm regulation" in the country when ruling on a gun control law.
And you know what the "historical tradition" of firearm ownership in the U.S. is like!
In addition to striking down the law on those grounds, Benitez pointed out just how unfair it is to the average citizen:
"[The law] creates the extreme policy that a handful of criminals can dictate the conduct and infringe on the freedom of law-abiding citizens," Benitez wrote.
Meanwhile, state AG Rob Bonta is threatening to appeal the decision again because "wEaPoNs of wAr have no place on California's streets."
What do you mean by that, Rob? Can you explain what that means? Do you know how guns work, bro? No?
Sadly, the decision is therefore pending again as California wages holy war on the magic white-man firesticks. That means I'm not actually sure what you Californians are allowed to buy to defend yourselves this Christmas.
Then again, California is about two years away from banning Christmas altogether, so then it won't matter at all, you bigots.
