There's no way he gets away with this ... right?
A reasonable person might conclude that President Biden is trying to do as much damage as humanly possible to the country as he leaves office, and this move takes the cake.
'It is long past time to recognize the will of the American people,' Biden said in a statement. 'In keeping with my oath and duty to Constitution and country, I affirm what I believe and what three-fourths of the states have ratified: the 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex.'
This is pretty much treasonous, and here's why.
The ERA failed to be ratified in the 1970s,
It has been decades since the amendment's time limit expired
Many of the states that ratified it at the time have reversed their ratification and/or would no longer ratify it today.
President Biden says that the Equal Rights Amendment, which purportedly bans discrimination based on sex, should be considered ratified and an official part of the United States Constitution.
A senior administration official said Biden was not going to direct the archivist to add it to the Constitution. The official said the archivist's role was 'purely ministerial,' and that she is 'required to publish an amendment once it has been effectively ratified.'
The ERA has been a matter of debate for decades and was nearly certified back in the 1970s until brave leaders like Phyllis Schlafly fought tooth and nail to talk sense into Republican and conservative states that fell for the ERA scam.
Even the semi-woke Southern Baptist ERLC knows why this is a bad amendment.
The full text reads:
SECTION 1. Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.
SEC. 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.
SEC. 3. This amendment shall take effect two years after the date of ratification.
From pro-life worries, to removing protections from women (such as exempting them from the military draft), to legally removing the distinctions of mother and father in the nuclear family, the ERA is a bust.
In 2020, Virginia became the 38th state to "ratify" the amendment; however it comes nearly 40 years past the built-in deadline to ratify, and after multiple states rescinded their ratifications.
Biden in a statement said that the ERA 'is the law of the land' because it was passed by a two-thirds majority in Congress and three-quarters of the states have ratified it. But he stopped short of instructing the archivist to add the amendment to the Constitution, making it unclear what effect the outgoing president's statement will have and likely inviting legal challenges.
It's not clear if this is simply bluster from the Biden crew on the way out, if the archivist will add the ERA as the 28th Amendment, or if any of this would hold up at all in front of the Supreme Court.
All I know is Biden seems to be giving America a giant mess of chaos on his way out the door.
