Killer of Texas State student shot through wall of apartment only sentenced to 90 days in jail

Austin Salyer was a Texas State University student who had just recently signed up for the Army when he was killed by a neighbor who accidentally shot his gun through the wall of Salyer's apartment.

The judge only sentenced the neighbor to a paltry 90 days in jail.

The family wants the killer, Gabriel Brown, to have a tougher sentence because after shooting through the wall he made no attempt to check on his neighbor and didn't contact authorities.

Brown did turn himself in, however, shortly after the shooting.

Police and medics were at the apartment at 11:15 AM the next morning, nearly 12 hours after the fatal shot.

It's unclear whether or not Austin could have been saved if help had gotten there sooner.

Brown was charged with the lowest possible crime in this incident, criminally negligent homicide. He pled guilty, and then a judge lowered his sentence from 180 days to 90 days without telling the family.

The family is going to the media and petitioning the judge, but they feel like they have no real recourse.

"We were like, how can that be? We weren't involved, nobody's told us anything about this. Well, the change to 90 days is this, the document was correctly typed up with 18 days. Someone scratched it out and wrote in nine. No, no initials. No, nothing," Rodney Salyer said. "If we didn't follow up with him, it would have just gone behind the scenes."

A request to review the sentencing was denied.
