Big fat free-speech update: Appellate court stays prison sentence of Doug Mackey, the man convicted for 2016 Hillary meme

In October, a court sentenced Trump-supporter Doug Mackey to 7 months in jail after ruling his attempt at making "memes" constituted election interference.

Now, an appellate court has sided with Mackey, saying he doesn't have to serve his prison sentence until after his appeal case. A positive development in the First Amendment case.

The Motion Order reads: "granting motion for release pending appeal, at docket entry 16 Mackey's surrender date is stated. The District Court is ordered to determine the appropriate terms of release, without prejudice to the government's making a future request for detention, on behalf of Appellant Douglass Mackey, It is further ordered that this appeal is expedited. Mackey's initial brief will be due on or before January 5, 2024. The government's response will be due on or before February 5, 2024. Mackey's reply brief will be due on or before February 20, 2024. The Clerk is directed to calendar this appeal as soon as practicable after February 20, 2024."

So, between now and the February case, Mackey will not have to serve any jail time.

The court apparently thinks that his fake Hillary graphics must not be an imminent threat to the public! Imagine that!

Mackey said if he loses the appeal, he will file with the Supreme Court:

If we lose the appeal in the Second Circuit, we will swiftly file an appeal with the Supreme Court.
