Remember when we told you about the off-duty pilot who tried to kill 88 people because he was experiencing a bad shroom trip?
Well, an Oregon jury has decided that Joseph David Emerson, the pilot in question, shouldn't be charged with attempted murder.
The grand jury decided to instead give Emerson the lesser charge of reckless endangerment.
Joseph David Emerson, 44, was charged with one count of endangering aircraft in the first degree and 83 counts of recklessly endangering another person in connection with the Oct. 22 incident, the Multnomah County District Attorney's Office said Tuesday.
Dude is lucky this case is being tried in drug-friendly and crime-friendly Oregon!
His lawyers argue that Emerson was completely out of his mind, thought he was in a dream, and therefore had no criminal intent and shouldn't be charged with ANY crime.
"Captain Emerson had no criminal intent, and we look forward to being able to present a fulsome defense at trial and bring forth all the facts and circumstances to a jury," his attorneys said. "Captain Emerson's defense team is crafting a release plan and expect that he will finally return home to his family by the end of this week."

Emerson is being held in jail and will be arraigned on Thursday.
