It seems the woman progressives celebrated as the "first LGBTQ federal judge in D.C." has gotten herself into some trouble.
The American Bar Association Journal reported at the end of last month that the Pam Bondi's Justice Department has filed an official misconduct complaint against Biden-appointed District Court Judge Ana Reyes. The U.S. Court of Appeals for the D.C. Circuit will decide if Reyes committed "hostile and egregious misconduct" in her recent hearing over Trump's efforts to revise the military's transgender policy.
What did she do? In simple terms, she attempted to Jesus-shame the government's attorneys by suggesting that the ban on transgenders in the military ran afoul of what "Jesus would do." Seriously.
From the courtroom transcript:
What do you think Jesus would say to telling a group of people that they are so worthless, so worthless, that we're not going to allow them into homeless shelters? Do you think Jesus would be, 'Sounds right to me?' Or do you think Jesus would say, 'WTF? Of course, let them in?'
This, to put it gently, is what happens when you appoint religious zealots and partisan activists to positions that should always be reserved for dispassionate, reasonable men and women with the capacity to think and act objectively.
First, notice the irresponsible leap of logic Judge Reyes makes, equating telling psychologically unbalanced or fetish-driven deviants that they are not fit for military service with telling them they are "worthless" and not permitted to eat or sleep in a homeless shelter. It's so absurdly hyperbolic, it indicates the workings of an emotionally volatile, not an intellectually stoic mind. That's not a good exchange in a field where logical grounding is a necessity.
Second, no matter what His position on military readiness or basic human decency would be, I think it's quite fair to say that unwholesome talk like "WTF" would not cross the mind, emerge from the heart, or escape the tongue of Jesus. Suggesting otherwise only indicates you don't know Jesus.
And finally, I'm curious when left-wing judges decided that the mentality and morality of Jesus should be the calibration point for our society's ethical compass and legal guideposts. Not that I am complaining about it, but if that's the new standard Reyes is wanting to inaugurate, she may not like where it leads.
To wit:
'Haven't you read,' he replied, 'that at the beginning the Creator "made them male and female," and said, "For this reason a man will leave his father and mother and be united to his wife, and the two will become one flesh"? So they are no longer two, but one flesh. Therefore what God has joined together, let no one separate.' - Matthew 19:4-6
'If anyone causes one of these little ones — those who believe in me — to stumble, it would be better for them to have a large millstone hung around their neck and to be drowned in the depths of the sea.' - Matthew 18:6
'Jesus straightened up and asked her, "Woman, where are they? Has no one condemned you?" "No one, sir," she said. "Then neither do I condemn you," Jesus declared. "Go now and leave your life of sin."' - John 8:10-11
For his part, the DOJ attorney in the courtroom that day, Jason Lynch, fired back at the judge's antics, "The United States is not going to speculate about what Jesus would have to say about anything."
If you've read enough of these federal court transcripts, you're able to read between the lines and hear Lynch's incredulous implication: How in the world are you an actual federal judge when you sound like a placard-holding, flag-waving, professional protester who chants in front of courtrooms rather than presides over them?
Reyes' response to him did little to dissuade such thoughts:
'You can't tell me that transgender people are not being discriminated against today,' she said.
Good grief. Having any standards for military service at all logically discriminates against some people.
We discriminate against those under 18 by telling them they can't serve.
We discriminate against physically handicapped people by telling them they can't serve in certain roles.
The question isn't whether our military will be discriminating, but rather where we discriminate in order to produce the most effective and lethal fighting force in the world.
That's what the Trump administration's efforts seem geared towards, if they can just get past the ideological carnival barkers we've got dressed in black robes, sitting on our federal courts.
