Oregon's new gun law violates the state's own constitution, judge rules

YEAH BOI! You know an outlet called "Oregon Democracy" hated reporting this:

A Harney County Circuit Court judge ruled Tuesday that Oregon's new gun laws, approved by voters last year under ballot Measure 114, violate the state constitution.

Measure 114 requires Oregon citizens to acquire a permit before purchasing a gun (not carrying it, mind you, but merely purchasing it). The permit includes a safety course requirement. It also forbids magazines with capacities larger than 10 rounds, which restricts the standard capacity of most modern semi-auto pistols and rifles.

This is all pretty standard gun-grabber gun control boilerplate, in other words.

Judge Robert Raschio ruled that the measure violated the state's own constitution (not to mention the US Constitution). He put it well in his decision:

Oregon citizens have a right to self defense against an imminent threat of harm, which is unduly burdened by Ballot Measure 114.

The judge further pointed out that the plaintiffs in their lawsuit "demonstrated definitively citizens cannot rely on law enforcement to respond quickly to their needs if they are subject to a break in or threat of deadly physical harm." When seconds count, the police are minutes away.

The ruling means that Oregon citizens can, for the time being, enjoy their constitutional right to firearms (though a higher court ruling could reverse Raschio's decision if the state takes the fight that far, and being uber-left, you can bet they'll try).

Oregon Attorney General Ellen Rosenblum has indicated she will file an appeal on the decision because of course.
