Not "potential crimes," but "crimes." I find that omission interesting.
This is the petition for a writ of certiorari before judgement that Special Counsel Jack Smith just filed with the Supreme Court, seeking an immediate judgement on whether President Trump can be charged and prosecuted for 1) perceived 2020 election interference or 2) the things he was accused of during his two impeachments by the House but was not convicted of by the Senate.
Trump's two impeachments were for pressuring Ukraine to give him details involving Hunter Biden and illegal activity of Joe Biden by extension (that was a TOTAL dead end, right?) and for the J6 Capitol riot, in which he had called for peaceful demonstration.
From the Associated Press:
"This case presents a fundamental question at the heart of our democracy: whether a former President is absolutely immune from federal prosecution for crimes committed while in office or is constitutionally protected from federal prosecution when he has been impeached but not convicted before the criminal proceedings begin," prosecutors wrote.
The earliest the court would consider the appeal would be Jan. 5, 2024, the date of the justices' next scheduled private conference.
Because you probably don't follow the legal world closely, I'm going to take a step back and remind you of the people in play here.
- Special Counsel Jack Smith was appointed by Attorney General Merrick Garland, who has weaponized the DOJ to go after political enemies, in 2022, to investigate Trump following Garland's raid on Trump's Mar-A-Lago home.
- Jack Smith charged Trump in early June with conspiracy to defraud the United States; conspiracy to deprive Americans of the right to a fair election process; conspiracy to obstruct Congress' proceedings on Jan. 6, 2021; and the carrying out of that obstruction effort.
- It came to light that aides for Jack Smith met with Biden officials before the charges were announced, because of course.
- Trump pled not guilty to all these charges.
- The trial of Trump is supposed to begin on March 4, 2024 - a hasty move clearly meant to convict Trump before the 2024 election.
Trump was impeached the first time because he smelled the nefarious quid pro quo game Joe Biden had played in Ukraine when Joe got a prosecutor fired who had been sniffing around Burisma, the corrupt energy company that had hired his son, with no relevant skills, to sit on its board.
We know from Hunter's laptop and subsequent whistleblowers that the Biden family had a massive enrichment operation going for their own family, using Hunter as a proxy to peddle Joe's political influence while Joe's brother Jim served as the money manager.
Now, the attorney general appointed by that very same Joe Biden is attempting to destroy Trump before the truth destroys Joe Biden, appointing a special counsel to eliminate Trump before he can be reelected and regain control of the executive branch, which would allow him to fire and prosecute anyone who went after him.

Out of that comes the question: Why is Jack Smith, a puppet of the Biden regime, asking for this clarification?
Underscoring the urgency for prosecutors in securing a quick resolution that can push the case forward, they wrote: "It is of imperative public importance that respondent's claims of immunity be resolved by this Court and that respondent's trial proceed as promptly as possible if his claim of immunity is rejected."
At issue is a Dec. 1 ruling from U.S. District Judge Tanya Chutkan that rejected arguments by Trump's lawyers that he was immune from federal prosecution. In her order, Chutkan, who was appointed by President Barack Obama, wrote that the office of the president "does not confer a lifelong ‘get-out-of-jail-free' pass."

You may not like it, but the election is 11 months away.
Smith must move quickly to do his master's bidding.
The regime has placed a gauntlet of charges in front of Trump, with strategic court dates, to hobble him. The problem is, the courts move slowly (by design, so tyrants can't execute their enemies like this).
By asking for an immediate and preemptive decision, Smith likely hopes to get the Court to open the door for his continued prosecution so that he may bring down the hammer with full force in March.
If Trump were convicted and jailed before he could become president, it would ignite a new civil war in this nation. I'm not advocating violence; I'm simply telling you what will happen. A country divided against itself like that simply cannot and will not stand.
Then, when Trump is in irons before the election and the nation begins burning, the regime can point to SCOTUS's earlier decision and say it was somehow fair.
What the Court decides (or doesn't decide) may be the most important decision for the United States of America since those rebels signed the Declaration in 1776.
Feels like we're reaching a lot of those "everything hangs on the edge of a knife" moments these days.
