International Court of Justice stops short of charging Israel with genocide, will not order ceasefire

Huge news from the International Court of Justice, the UN's top court, which will not charge Israel with genocide but has ordered the country to take measures to prevent acts of genocide in Gaza.

South Africa filed the suit back in late December accusing Israel of genocide in their offensive in the Gaza Strip following the terror attacks of October 7. A month later and we have a ruling from the International Court of Justice.

The International Court of Justice (ICJ) has delivered its ruling on the emergency measures requested by South Africa in its genocide case against Israel over its war on the Gaza Strip.

The World Court on Friday did not order a ceasefire in Gaza but told Israel to take measures to prevent and punish direct incitement of genocide in the besieged strip.

ICJ President Joan Donoghue noted that the court had found sufficient evidence of dispute for the genocide case and said it will not throw it out.

Israel has also been ordered to allow humanitarian aid into Gaza and has been asked to report back to the court within a month about how it is upholding the court's orders.

Israeli Prime Minister Benjamin Netanyahu says his government will continue to defend itself and protect its people, saying his country is fighting a "just war like no other."

Israel's commitment to international law is unwavering. Equally unwavering is our sacred commitment to continue to defend our country and defend our people. Like every country, Israel has an inherent right to defend itself. The vile attempt to deny Israel this fundamental right is blatant discrimination against the Jewish state, and it was justly rejected. The charge of genocide leveled against Israel is not only false, it's outrageous.

Though the court stopped short of ordering a ceasefire, Israel has been ordered to take all possible measures to prevent genocide in Gaza.

  • Israel must take all possible measures to prevent acts as outlined in Article 2 of the 1948 Genocide Convention.
  • Israel must ensure its military does not carry out any of the above actions.
  • Israel must prevent the destruction of evidence of war crimes in Gaza and allow fact-finding missions access.
  • Israel must submit a report on how it intends to deliver all of the above to the court within one month of the judgement.
  • Israel must prevent and punish incitement of genocidal acts.
  • Israel must ensure the delivery of basic services and essential humanitarian aid to civilians in Gaza.

Israel has effectively been put on on notice, and must report back to the court within a month concerning measures they've taken to prevent genocidal acts.
