New footage shows subway passengers tell police that Daniel Penny acted heroically and respectfully in subduing Jordan Neely

Look at this:

Woman 1: 'He hopped on the train saying he was ready to die, you know, he didn't care and - '

Officer 1: 'He was being belligerent?'

Woman 1: 'Very, very.'

Woman 2: 'The whole train was freaked out he was either gonna pull a gun, a knife, or like-'

Woman 1: 'He said, "I'm willing to die, I'm willing to die!" You know, "I'm willing to get killed," and, yeah.'

Woman 2: 'The guy in the tan [Penny] did take him down really respectfully'

Woman 1: 'Yeah.'

Woman 2: 'He just held him down, like - '

Woman 1: 'Yeah, he just held him down, he didn't choke him.'

[Pause]

Woman 1: 'I think that the guy [Neely] is totally drugged out.'

[Time jump]

Officer 2 to Woman 1: 'What did you see?'

Woman 1: 'I was sitting over there [points to train car] and the young man who is on the floor was saying "I'm willing to die," you know, "I'll do anything" ... he was saying it so loud that everyone turned around [officer yelling to crowd interrupts]. He [Neely] got belligerent and he tackled him down.'

Officer 2: 'Who?'

Woman 1: [Pointing toward Penny] 'The one who just passed away in the brown jacket, the one who just went past.'

Officer 2: 'The guy in the brown jacket?'

Woman 1: 'Yeah.'

[Police ask some clarifying questions as a train passes]

Woman 1: '[Penny] put [Neely] in a chokehold. Not a hard chokehold; just enough to secure him. And he kept holding him. And that's when everyobody totally realized what was going on.'

To recap:

  • Marine vet Daniel Penny used a by-the-book chokehold to subdue a repeat violent felon, Jordan Neely, who was threatening New Yorkers on the subway. Eyewitnesses testified that he only stopped Neely when the latter became violent.

  • After the chokehold, Penny is on video placing Neely in the recovery position to make sure Neely was safe. Nearby passengers praised him for his heroic efforts.

  • Police testified that Jordan Neely was still alive when officers showed up and they administered Narcan to reverse a suspected overdose.

  • Police also testified that they didn't administer mouth-to-mouth because Neely looked "very dirty" and officers were concerned about getting hepatitis.

  • Neely was on a list of the Top 50 most "at-risk" homeless people in New York city and was known to police.

  • Penny has disavowed the DA's assertion that there was any racial animus involved in subduing Neely.

  • Despite this, DA Alvin Bragg's deputy keeps referring to Penny in court as "the white man."

  • Witnesses testified at trial that Neely was "trying to attack everybody" on the train.

  • This bodycam footage now shows eyewitnesses at the scene saying that Penny acted with proper restraint in subduing a violent man.

Remind me, why does DA Alvin Bragg still have a job after this disgusting miscarriage of justice?
